Welcome to Nova Nexus TCG (novanexustcg.ca). These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By placing an order or using our site, you agree to be bound by these Terms. If you do not agree, please do not use this site.

1. About Us

Nova Nexus TCG is operated by Nova Nexus Trading Inc., a federally incorporated Canadian corporation based in the Greater Toronto Area, Ontario, Canada. We sell factory-sealed, authenticated Pokémon Trading Card Game products directly to consumers across Canada and the United States.

For wholesale or bulk business-to-business (B2B) inquiries, please contact us directly through our Contact page. B2B orders are not processed through this website and are subject to separate terms agreed upon directly with our team.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your province/state of residence, to make a purchase on this site. By placing an order, you confirm that you meet this requirement.

3. Product Authenticity

All products sold by Nova Nexus TCG are 100% authentic, factory-sealed Pokémon TCG products. Every item is verified prior to shipment. We do not sell reproductions, counterfeit, or resealed product. If you believe you have received a product that does not meet this standard, contact us immediately per Section 8 (Returns & Refunds).

4. Pricing and Availability

  • All prices are listed in Canadian Dollars (CAD) or United States Dollars (USD), depending on your selected region, and are subject to change without notice.
  • Prices reflect current market conditions for sealed collectible product and may differ from manufacturer's suggested retail price (MSRP).
  • We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or inventory discrepancies.
  • Product availability is not guaranteed until an order is confirmed and payment is processed.

5. Orders and Payment

  • By placing an order, you represent that all information provided (billing, shipping, payment) is accurate and complete.
  • Payment is processed securely at checkout via Shopify Payments. We do not store your full payment card details.
  • We reserve the right to cancel or refuse any order for any reason, including suspected fraudulent activity, pricing errors, or product unavailability. If your order is cancelled, you will be refunded in full.

6. Pre-Orders

Certain products listed on our site may be available for pre-order ahead of their official release or restock date.

  • Pre-order items are charged at the time of order placement unless otherwise stated on the product page.
  • Estimated release or ship dates are provided in good faith based on information available to us at the time of listing, but are subject to change due to manufacturer delays, supply chain disruptions, or other factors outside our control.
  • We will make reasonable efforts to notify customers of any significant delay to a pre-order shipment.
  • Pre-orders may be cancelled by the customer prior to shipment for a full refund by contacting us per Section 9.
  • Once a pre-order has shipped, standard return policies (Section 8) apply.

7. Shipping

  • We currently ship within Canada and to the United States. Shipping rates and delivery estimates are provided at checkout.
  • Risk of loss and title for products purchased passes to you upon our delivery to the carrier.
  • We are not responsible for delays caused by the shipping carrier, customs processing, weather, or other events outside our control.
  • It is the customer's responsibility to provide an accurate shipping address. We are not responsible for orders misdelivered due to incorrect address information provided at checkout.
  • For international (US) orders, the customer is responsible for any applicable customs duties, taxes, or import fees.

8. Returns, Refunds & Damaged Items

  • Due to the nature of sealed collectible products, all sales are final once an order has shipped, except in the following cases:
    • The item arrives damaged in transit
    • The item received does not match what was ordered
    • The item is not factory-sealed or authentic as represented
  • Claims for damaged, incorrect, or non-authentic items must be submitted within 48 hours of delivery, with photo evidence of the item and packaging, via our Contact page.
  • Approved claims will be resolved via replacement, store credit, or refund at our discretion.
  • We do not accept returns due to change of mind, market price fluctuation, or because a product was opened after delivery.

For any order issues, cancellations, pre-order changes, or damage claims, please reach out via our Contact page as soon as possible. We aim to respond to all inquiries within 1-2 business days.

10. Limitation of Liability

To the fullest extent permitted by law, Nova Nexus Trading Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or purchase of our products, including but not limited to loss of value of collectible items, missed releases, or secondary market price fluctuations.

11. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Nova Nexus Trading Inc. or its licensors and is protected by Canadian and international copyright and trademark law. Pokémon, related characters, and trademarks are the property of The Pokémon Company, Nintendo, Game Freak, and Creatures Inc. Nova Nexus TCG is not affiliated with, endorsed by, or sponsored by The Pokémon Company or its affiliates.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
